Recently, our team was asked a question: “Подруга прислала посылку с другого города новой почтой, упаковка была целая, но содержимое повредилось. Сотрудники говорят, что они не причём, и это не их вина. Что могу сделать в этом случае? Как компенсировать ущерб?”

05.10.2021 08:57:29 Для облегчения процедуры получения компенсации следуйте следующим рекомендациям: при наличии претензий к состоянию отправления составьте Акт приема-передачи и Претензию сразу при получении посылки. Новая почта должна выплатить компенсацию клиенту. Кроме того, обратная доставка будет осуществлена за счет Новой почты. Скажу сразу, Вам придется поругаться, но все же добиться компенсации возможно, вплоть даже через суд, если посылка того стоит. Желаю удачи.

05.10.2021 13:26:31 Нужно было составить акт о наличии повреждения сразу в отделении почты. Если этого не сделали, отправьте письменную претензию онлайн и зарегистрируйте её жалобой в телефонном режиме.

07.10.2021 17:09:30 Відповідно до ст. 924 ЦКУкраїни перевізник відповідає за збереження вантажу, багажу, пошти з моменту прийняття їх до перевезення та до видачі одержувачеві. Перевізник відповідає за псування або пошкодження посилки в розмірі фактичної шкоди, якщо не доведе, що це сталося не з його вини. Під псуванням або пошкодженням посилки розуміють зміну її фізичних властивостей (механічні поломки, дефекти, бій). Перевізник звільняється від відповідальності за пошкодження посилки тільки у випадках, коли незбереження вантажу стало наслідком обставин, що характеризуються одночасно такими ознаками: усунення цих обставин не залежало від перевізника. Тобто, перевізник звільняється від відповідальності, якщо відповідно до законодавства та договору він не несе обов’язку усунення цих обставин; перевізник не міг запобігти цим обставинам.
