Recently, our team was asked a question: “У вопрос если я получил военный билет без присяги как добровольно мобизированый . Скажите могу ли я уйти из армии если до войны я был снят с военного учета по таким статьям( ст.37 п.5 п.п2.3 абзац 4 ; накМОУ номер 342 от 9.06.06 ) в военной форме номер 3 вместо военного билета . На основаниии чмт травмы и заболеванием мененгит . Но осталась копия этого бланка о форме 3 оригинал был утерян . Могули ли я на основания этой копии уйти из армии и как это зделать при наличии военного билета?”

31.05.2022 08:17:23 Подайте рапорт командиру об увольнении с воин.службы на основании пп.«б» п.2 ч.4 ст.26 ЗУ "Про військовий обов'язок і ВС" (4. військовослужбовці, які проходять ВС за призовом під час мобілізації, на особл.період, ВС за призовом осіб із числа резервістів в особл.період, звільняються з ВС на підставах 2) під час воєнного стану б) за станом здоров’я - на підставі висновку (постанови) ВЛК про непридатність до військ.сл. з виключенням з військ.обліку). Вам надо будет проходить ВЛК, если признают по болезням непригодным с ислючением, то обязаны будут уволить. Ранее, у Вас было снятие, а не исключение с воин.учёта, тут это не поможет, а Наказ МОУ №342 від 09.06.2006 втратив чинність по наказу МОУ 24 від 15.01.2015, его нормы не учитываются, и надо только проходить ВЛК сейчас. Ищите болезнь в подходящей по названию статье в таблице Дод.1 "Розклад хвороб" https://zakon.rada.gov.ua/laws/show/z1109-08#top, буква "а" это непридатний до ВС, по другим буквам в воен.стан считаются пригодными (п.20.4)

31.05.2022 14:10:45 Доброго дня. Якщо Ви раніше був знятий з військового обліку, можливо Ви був визнаний непридатним до військової служби у мирний час і обмежено придатним у воєнний. Зараз в Україні діє правовий режим воєнного стану, тому Вас за таких умов могли поновити на військовому обліку. Тепер за наявності вказаних Вами документів можете рапортом на ім'я командира просити про направлення на військово-лікарську комісію (ВЛК), під час проведення якої пред'явити документи про наявність травм та хвороб та наполягати на проведенні повноцінного медичного обстеження. Якщо за результатами ВЛК Вас буде визнано непридатним до військової служби - отримаєте звільнення (відстрочку) від мобілізації.
