Recently, our team was asked a question: “Здравствуйте. Я потерпевший в дтп и у меня такой вопрос: могу ли я получить возмещение убытков непосредственно от виновника? То что от страховой я получу - это понятно. Но могу ли я еще например моральный ущерб взять у виновника? Можно ли взять у него деньги не через суд? Спасибо!!!”

08.04.2021 21:34:41 Здравствуйте. ДТП могут быть как административные так и уголовные. Если это 124 КУпАП, то в суде установят виновного, соответственно второй Потерпевший. Когда решение вступит в законную силу (возможно после апелляционного суда), то Потерпевшая сторона может обратится в суд в гражданском порядке с исковым заявлением о взыскании материального (если страховая выплатила меньше чем стоимость ремонта) и морального вреда. Включите простой, упущенную выгоду, разницу при продаже авто (хуже продаются битки), может авто было новым и так далее. Если говорим о ст.286 УК Украины, то потерпевший может во время досудебного расследования или на подготовительном заседании в суде заявить гражданский иск, который рассмотрят и в приговоре уже опередят вину и возмещение ущерба (материального и морального). Можно путём переговоров попробовать получить денежные средства, но это его право и выбор добровольно компенсировать или нет, люди то разные бывают. Советую получить письменные подтверждения платежей

09.04.2021 01:14:19 Доброго дня! Питання вирішення та отримання компенсації за моральний збиток залежить лише від особистості та характеру винної особи в дтп. Якщо Він буде згоден вирішити дану проблему з Вами не прибігаючи до судових тяжб, то у такому разі є сенс на вчинення таких дій. В іншому ж випадку, якщо Він відмовиться компенсувати Вам суму за моральний збиток, залишається лише варіант із вирішенням даної проблеми в судовому порядку. Дякую!

13.04.2021 23:59:19 Так, можна. Можна виставити йому вимогу, якщо заплатить добровільно, то добре. А якщо ні - то тільки через суд із позовом про стягнення шкоди, завданої ДТП та моральної шкоди. При цьому, шкоду задану ДТП можна пред'явити до стягнення ту, яка не покривається страховою. Важливо, щоб була постанова, що у ДТП винна інша сторона.
