22.07.2021 10:03:19 Доброе утро. Продать квартиру обычным путем по договору купли-продажи нельзя, так как на нее еще не получено свидетельство о праве собственности. В вашей ситуации возможна уступка права требования, при которой право, принадлежащее вам на основании обязательства, передают другому лицу. В результате такой сделки уступающий право выходит из договора с должником(застройщиком), а приобретающий уступку становится новым кредитором. Уступка имущественного права на квартиру, приобретенную по договору участия в долевом строительстве, возможна с момента государственной регистрации такого договора. Договор уступки права также подлежит государственной регистрации. Если найдете покупателя, оформляйте все документы у нотариуса. Спасибо.

29.07.2021 18:53:48 Стаття 177 ЦКУ серед об'єктів цивільних прав називає майнові права. Вони ж визначаються речовими правами згідно з ч.2 статті 190 ЦКУ. Але визначення майновим правам Цивільний кодекс не дає. В статті 3 Закону України “Про оцінку майна, майнових прав та професійну оціночну діяльність в Україні” майновими правами, які можуть оцінюватися, визнаються будь-які права, пов'язані з майном, відмінні від права власності, у тому числі права, які є складовими частинами права власності (права володіння, розпорядження, користування), а також інші специфічні права (права на провадження діяльності, використання природних ресурсів тощо) та права вимоги. Згідно зі ст. 656 ЦК майнові права можуть бути предметом договору купівлі-продажу, нормою ст. 658 ЦК встановлено, що право продажу товару, крім випадків примусового продажу та інших випадків, встановлених законом, належить власникові товару.
