29.06.2021 18:19:57 Если в момент оформления страхового полиса страховая компания была проинформирована о том, что транспортное средство будет использоваться в режиме автопилота, тогда она несет полную ответственность по застрахованному авто. Если беспилотный автомобиль не застрахован, тогда в случае аварии ответственность будет нести автовладелец. Если аварийная ситуация возникла по причине сбоя в программном обеспечении или оборудовании, тогда вина ложится на плечи компании-производителя. Спасибо. Будьте осторожны.

Субъектом ответственности в данной ситуации является лицо, которое управляло транспортным средством (передача права управления транспортным средством автопилоту является формой управления транспортным средством). Управление означает не только нажатие на педаль или сидение на водительском месте, по аналогии с круиз контролем, водитель может не касаться педалей. Ответственность предусмотрена ст. 122 КоАП. 30.06.2021 19:44:50 Доброго Дня Водія якщо він сидить на пасажирському сидінні не можна притягнути - неможливо буде довести належними та допустимими доказом його причетність до водіння. Щодо випадку якщо постануть наслідки - дтп, пошкодження майна тощо, адмінпокарання не буде, а от цивільна відповідальність власника джерела підвищеної небезпеки яка, до речі, презюмується, буде - тобто за порушення пдд за чинним законодавством не притягнути нікого, а всі завдані збитки покладаються на власника авто з автопілотом, якщо власник буде мати докази що збитки завдано внаслідок помилки автопілота, він зможе регресом стягнути кошти з виробника автомобіля. Проте зазначу також, що водій порушив правила експлуатації транспортного засобу. В інструкції до Tesla прямо написано про те, що перед включенням автопілота водій погоджується, що залишається відповідальним за керування автомобілем та повинен тримати руки на кермі
