06.07.2021 21:39:23 Добрый вечер. Так как наследство не является доходом, тоесть не носит постоянный характер, то и алименты с него взыскать нельзя. Но есть свои тонкости. Допустим Вы будете здавать унаследованное имущество и получать доход или продадите наследство, тогда суд сможет взыскать с Вас алименты. Спасибо.
07.07.2021 18:27:19 Добрый день. Согласно действующему законодательству, алименты уплачиваются из суммы дохода. Наследство доходом не является, следовательно, алименты с наследства в обычной ситуации не уплачиваются. Благодарю.
19.07.2021 16:16:24 Выплата алиментов неразрывно связана с тем, кто обязан их платить. Если такой человек умирает - его обязательство по выплате алиментов прекращается. Вы не обязаны выплачивать алименты вместо него. Но, если при жизни ваш отец задолжал некую сумму по алиментам бывшей жене, вы обязаны оплатить эту задолженность, так как по 1218 статье Гражданского кодекса Украины (ГКУ) в состав наследства входят не только права, но и обязанности - то есть то, что умерший должен был выполнить, но не выполнил. Также 1282 статья ГКУ обязывает вас расплатиться по долгам покойного отца, но только в сумме полученного наследства (то есть, если долг 10000 гривен, а имущества вы унаследовали на 5000 гривен, то выплачиваете по долгу только 5000 гривен). Если же долга по алиментам у вашего покойного отца на момент смерти не было, а его бывшая жена требует, чтобы вы выплачивали алименты вместо него и дальше - то это требование незаконно, и обязанности выплачивать алименты по закону у вас нет, и быть не может.
