Недавно нашей команде задали вопрос: “Здравствуйте. Есть ли смысл бодаться с компанией? 5 месяцев назад меня вынудили уволиться по собственному желанию, я тогда была на 4-5 неделе беременности. По закону меня не могли уволить, но я не хотела чтобы кто-то об этом знал на таком маленьком сроке, потому что всё очень нестабильно бывает... Могу ли я как-то сейчас требовать компенсацию или что-то вроде того от компании или не имеет смысла? ”

Вітаю, згідно ст. 233 КЗпП для звернення до суду з метою вирішення трудових спорів встановлено строк у 3 місяці, проте у справах про звільнення (Ваш випадок), встановлено термін в один місяць. Отже процесуальні строки у Вашому випадку пропущені. Проте якщо у Вас вийде довести, що строки пропущені з поважних причин, Ви можете їх поновити (ст. 127 ЦПК). Але! На момент звільнення роботодавець не знав про Ваше звільнення? Якщо роботодавець не знав про вагітність і Ви подали заяву на звільнення за власним бажанням, буде досить проблематично суду довести, що Вас звільнили не законно.

Доброго дня! Відповідно до ст. 233 Кодексу законів про працю України працівник може звернутися з заявою про вирішення трудового спору безпосередньо до районного, районного у місті, міського чи міськрайонного суду в тримісячний строк з дня, коли він дізнався або повинен був дізнатися про порушення свого права, а у справах про звільнення - в місячний строк з дня вручення копії наказу про звільнення або з дня видачі трудової книжки.
