Recently, our team was asked a question: “Здравствуйте, имеют ли пограничники какие либо законные основания для того чтобы не выпустить меня за две недели до моего 18ти летия? Мне нет полных 18ти лет и соответственно я не попадаю под категорию мобилизации, но зная нашу страну может приключиться все что угодно. Если пограничная служба решит отказать мне в пересечении границы, то что мне лучше всего делать дабы добиться своего?”

Не мають права, але в разі вчинення протиправних дій, що можуть виразитись у відмові щодо перетину кордону, то необхідно одразу скаржитись на гарячі лінії, викликати на місце поліцію та далі направити адвокатський запит для отримання документів, що стали підставою прийняття такого рішення.
15.11.2022 14:58:22 Перетин кордону заборонено чоловікам віком від 18 до 60 років, у котрих немає підстав для відстрочки або підстав для перетину. З точки зору Закону, Вас повинні пропустити на кордоні. У разі відмови - варто вимагати отримати письмову відмову, та в подальшому її оскаржувати.

Посилайтесь на абзац 2 частини 3 статті 313 Цивільного кодексу України: Фізична особа, яка досягла шістнадцяти років, має право на вільний самостійний виїзд за межі України. Інші обмеження є незаконними, якщо будуть проблеми, телефонуйте на гарячу лінію Прикордонної служби та залишайте скарги.
