Получение ОГД за погибшего, после смены статуса

Recently, our team was asked a question: “Отец пропал без вести мы совместно с адвокатом подались в суд, чтобы изменить статус с без вести пропавшего на погибшего, сейчас Минобороны подала в апелляцию и у меня закончились деньги на дальнейшую работу с адвокатом, что будет, если не выиграть апелляцию, будет ли возможность в дальнейшем получить эти выплаты по ОГД?”

01.03.2025 16:27:30 Если вы не выиграете апелляцию и статус вашего отца останется без вести пропавшим, то возможность получить выплаты по ОГД будет зависеть от конкретных обстоятельств вашего дела. Вам следует обратиться за консультацией к другому адвокату или юристу, чтобы узнать о возможных дальнейших шагах и способах защиты ваших прав. Также можно попробовать обратиться за помощью к государственным органам или некоммерческим организациям, занимающимся поддержкой семей пропавших без вести.
01.03.2025 22:13:41 Вітаю. Якщо апеляційний суд скасує рішення про визнання вашого батька загиблим, то його статус залишиться "безвісти зниклий", а це вплине на можливість отримання виплат. Виплати за загиблого військовослужбовця (ОГД) не надаються, поки особа вважається безвісти зниклою. Статус "безвісти зниклого" можуть переглянути пізніше, якщо з’являться нові докази. Через 2 роки після зникнення можна подати повторно (або після офіційного визнання місця загибелі).

У випадку якщо апеляція буде програна - статус Вашого батька так і буде - "Безвісти зниклий" та відповідно підстави для виплати ніякої не буде! в даному випадку потрібно боротись до кінця з апеляцією або ж чекати поки батько не з'явиться (не знайдуть тіло або ж він не опиниться живим в полоні, тощо!)
03.03.2025 11:04:43 Вітаю! Якщо апеляція Міноборони буде успішною і рішення про зміну статусу скасують, отримати одноразову грошову допомогу (ОГД) поки що не вдасться. Проте родини зниклих безвісти військових можуть отримувати 50% грошового забезпечення військового, розподіленого між найближчими родичами. Для цього потрібно подати заяву командиру військової частини через ТЦК із копіями паспорта, свідоцтва про народження та іншими документами. Якщо в майбутньому батька визнають загиблим, можна буде отримати ОГД, розмір якої залежить від обставин. Рекомендується звернутися до безкоштовних юридичних організацій, які допомагають сім’ям військових, та зберігати всі документи для можливості повторного звернення у майбутньому.
