Recently, our team was asked a question: “Чи можу я оформити на себе авто якщо на мене оформлена довіреність на продаж?”

08.04.2025 22:22:35 Вітаю. Якщо на вас видана довіреність на продаж, це означає, що ви маєте повноваження виступати посередником для укладення угоди за автомобілем від імені власника. Якщо ви є зацікавленою стороною (покупцем), то для оформлення авто на своє ім’я має бути складено окремий договір купівлі-продажу між власником (через представлення за довіреністю) і вами. Тобто, вам необхідно офіційно купити автомобіль, а потім пройти процедуру реєстрації транспортного засобу. Отже, за наявності лише довіреності на продаж оформити автомобіль на себе не можна.

14.04.2025 11:37:48 Вітаю! Якщо у вас є генеральна довіреність на продаж авто, то ви дійсно маєте право продати транспортний засіб, але оформити його на себе напряму за довіреністю не можна. Законодавство України не дозволяє використовувати довіреність для укладення правочину із самим собою, тобто ви не можете бути одночасно представником продавця і покупцем. Щоб оформити авто на себе, є два варіанти: Власник авто має оформити на вас договір купівлі-продажу напряму. Це найбезпечніший і юридично правильний спосіб. Ви підписуєте договір, реєструєте авто в сервісному центрі МВС, і стаєте повноцінним власником. Знайти третю особу, якій ви формально продасте авто, а вона потім оформить його на вас. Але це більш складний і менш надійний шлях, який може викликати підозри або суперечки. 📌 Якщо ви хочете уникнути ризиків — зверніться до нотаріуса або сервісного центру МВС, де вам підкажуть, як безпечно провести оформлення власності.
