Выходила замуж в Украине. Муж хочет развестись. Живем в Турции, здесь и будем подавать на развод через суд. Какая процедура развода с иностранцем? Можно ли развестись в другой стране? Какой порядок раздела общего имущества супругов? Как суд определяет с кем останется ребёнок после развода?”

25.11.2020 19:42:27 Якщо заява про розлучення буде подаватися у Туреччині, то за їх законодавством і за процедурою, передбаченою у них. Можна подати на розлучення тут і тоді за законами України. Порядок поділу майна за загальним правилом 50 на 50 все майно, набуте подружжям у шлюбі. Звісно є винятки. Як правило суд в Україні залишає дитину з матір'ю. У арабських країнах з батьком. І взагалі є проблеми вивезення дітей, якщо вони народились у таких країнах тільки з дозволу батька. Незалежно від того, які рішення ви приймете вам знадобитися професійна допомога юриста.

28.11.2020 18:06:31 Заявление на развод в Турции подаётся как и в Украине по месту прописки. В Турции возможно подать в органы правопорядка прошение о защите в виду бракоразводного процесса если супруг агрессивно настроен. С учетом того, что брак заключён в Украине, при разводе будут применятся нормы семейного кодекса Украины и гражданского процессуального кодекса Украины. Поэтому при применении норм законодательства Украины вообще положение более выгодное. К тому же в суд можно подать с заявлением о расторжении брака также согласие или договор о том, где будет проживать ребёнок и прочих условиях, в том числе имущество. кроме того, необходимо понимать был ли легализирован брак в Турции, с учетом того что был заключён в Украине, что также дадут почву для «манёвров»
