12.02.2021 18:10:29 Доброго дня. Відповідно до законодавства України визнати за Вами право власності на даний будинок можливо у судовому порядку за набувальною давністю. Набувальна давність – це засіб отримання права на нерухоме або рухоме майно особою, яка не є власником такого майна, але добросовісно, відкрито та безперервно володіє ним як своїм власним нерухомим майном протягом десяти років або рухомим майном – протягом п’яти років. Трапляються випадки, коли особа володіє майном, не будучи його власником. Усунути всі сумніви у належному їй праві можна, звернувшись до суду з вимогами про визнання права власності на майно за набувальною давністю. ОМС як органи, уповноважені управляти майном відповідної територіальної громади, виступають відповідачами у справах за позовними вимогами про визнання права власності за набувальною давністю.
