Recently, our team was asked a question: “У мене є бізнес, займаюсь криптовалютою. Хочу зареєструвати торгову марку своєї компанії, щоб міг робити вивіски, приймати платежі на цей бренд. Які документи треба щоб зареєструвати ТМ? Який орган реєструє торгові марки та скільки це займе часу?”

03.02.2021 21:03:58 Для реєстрації ТМ вам треба звернутись до Державного підприємства "Укрпатент" з заявою про реєстрацію (на сайті "Укрпатент" є зразок заяви). До заяви додаються: зображення торговельної марки розміром 8х8 см в електронному та друкованому видах, у 5 примірниках для чорно-білої торгової марки і у 10 – для кольорової; повний перелік товарів і/або послуг, для яких передбачається реєстрація товарного знака; повне найменування заявника українською мовою (назва фірми, її юридична адреса або ПІБ та місце проживання фізичної особи). Строк реєстрації - 14-18 місяців. Скорочений строк реєстрації (за доплату) 6-7 місяців. Розмір оплати за звичайну та скорочену реєстрацію ви зможете дізнатись у ДП "Укрпатент".
04.02.2021 00:04:16 Право власності на торгову марку засвідчується свідоцтвом, яке видає національним органом інтелектуальної власності, функції якого виконує державне підприємство «український інститут інтелектуальної власності» (Укрпатент). Тобто звертатися треба із заявкою до Укрпатенту або подати її електронну форму на сайті укрпатенту, що є більш простим. Строк дії свідоцтва 10 років і може бути продовженим ще на 10 років. До заявки подаються зображення торгової марки, дані про заявника, список товарів або послуг щодо торгової марки. Після подання заявки буде проходити її експертиза, а її стан модна переглядати на сайті Укрпатент. Після позитивної експертизи приймається рішення про реєстрацію торгової марки і видається свідоцтво. По часу важко сказати, адже індивідуально для кожної заявки залежно від складності. Існує така особа, як «патентний повірений» - представники у справах інтелектуальної власності, які зможуть пришвидшити цей процес та належно подати всі документи
