Але якщо у вас є докази того, що купівля квартири була здійснена лише за ваш рахунок і кошти вашого батька, то це може мати значення при розгляді справи у судовому порядку. Доказами можуть бути фактури оплати за квартиру або документи про переказ коштів на ваш рахунок. Також можна намагатися отримати свідчення свого батька про те, що це його кошти. У будь-якому разі, найкращим варіантом буде звернутися до професійного юриста, який має досвід у розгляді подібних справ. 01.12.2023 10:13:59 Якщо квартира придбана за особисті кошти, то так це треба саме довести, тому що у випадку придбання квартири у шлюбі чоловік претендує не на 1/4 квартири, а рівно на половину. Але розлучення це одне, а поділ майна - це інше. Якщо в позовній про розлучення вимоги щодо поділу майна не має, то це питання можна вирішувати в нотаріуса або іншим позовом. Доводити - доказами, документами, платіжками. Наприклад - дохід чоловіка за вказаний період і ваш та ваших батьків.

06.12.2023 15:14:54 Доброго дня! Спільно нажите майно під час шлюбу підлягає поділу. Можна доказати це тільки якщо є світки того як ваші батьки давали кошти вам особисто на придбання житла. якщо ви це докажете тоді майно не буде підлягати поділу
