Recently, our team was asked a question: “Здравствуйте, во дворе службы не убирают снег. Как я понимаю этим должны заниматься коммунальщики. Возможности выехать на автомобиле нет, кто за это должен нести ответственность. Люди опаздывают на работу и так далее. Можно ли сыскать деньги на счёт дома/двора за не убранной двор? Спасибо”

09.02.2021 15:51:33 Здравствуйте. Давайте сразу разграничим понятия - коммунальные службы несут ответственность за неубранный двор только в том случае, если в этом доме не создано ОСМД. В этом случает ответственность за расчистку от снега придомовой территории несет председатель ОСМД, в обязанности которого входит найм дворников и организация их работы, а также контроль за дворниками. Насчет взыскания - за неуборку снега во дворе взыскание в пользу жителей дома законом не предусмотрена. Предусмотрена административная ответственность - штраф от 850 до 1700 гривен (статья 152 Кодекса об административных правонарушениях). Штраф налагается либо на председателя ОСМД, либо на директора коммунального предприятия. Что вы должны делать - направляйте письменное обращение в коммунальное предприятие с требованием убрать снег, копию обращения отправляйте в управление по благоустройству при городском совете. Не будет реакции - отправляете повторное обращение. После первого обращения снег уберут. Нет - с иском в суд.
09.02.2021 16:57:21 Добрый день. В первую очередь, надо понимать кто является балансодержателем территории, где не убрано. За дворы многоэтажек, как правило, ответственны ЖЭКи, ОСББ или обслуживающие компании. Для решения вопроса я бы советовала обращаться в городской совет города или, например, в Киеве на телефон контактного центра Киева 1551, в департамент благоустройства КГГА или администрацию района. Вынесение положительного решения о взыскании денежных средств на счет дома/двора за не убранный двор маловероятно, т.к. Вы, как истец, обязаны в суде документально подтвердить полученный Вами вред от не убранного двора. Желаю Вам успеха и расчищенных дорог!
