08.12.2020 14:05:50 Вітаю, трохи неконкретно задане питання, Ви маєте на увазі страхову виплату через настання страхового випадку чи дострокове розірвання Договору з виплатою викупної суми? У випадку, якщо Ви бажаєте отримати кошти у наслідку настання страхового випадку, необхідно звернутись із відповідною Заявою (дивлячись у галузі якого саме типу страхування має бути виплата), надавши відповідні докази настання страхової події, різновиди відповідних Заяв містяться на офіційному сайті СК "ТАС". Якщо Ви бажаєте достроково повернути кошти розірвавши Договір страхування, необхідно підготувати заяву, що буде містити викладені причини розірвання Договору. До Заяви додається копія Договору страхування, а також докази сплати страхових внесків, сторони розраховують суму коштів, що має бути виплачено і укладають Додаткову угоду про розірвання Договору. Зауважу, що з цієї суми буде ще вирахувано 15% - податок з доходів фізичних осіб і ще 4% на "розрахунково-касове обслуговування та податок, сплачений страховиком.

Для того, щоб відповісти на Ваше питання необхідно розуміти суть страхового полісу (договору), в тому числі умови настання страхового випадку та умови виплати страхового відшкодування. Крім того необхідно розуміти чи є у вас франшиза (частина, що не відшкодовується). Ст. 36 ЗУ «Про обов’язкове страхування цивільно-правової відповідальності власників наземних транспортних засобів» - страховик протягом 15 днів з дня узгодження суми, але не пізніш як через 90 днів з дня отримання заяви про страхове відшкодування зобов’язаний прийняти рішення про здійснення страхового відшкодування та здійснити виплату. За кожен день прострочення виплати сплачується пеня, тому час грає на Вашу користь. Але памятайте що є строк позовної давності - 3 роки. Якщо пропустити цей строк кошти буде складно стягнути. 09.12.2020 18:36:06 Написати заяву про повернення та вказати підстави для такого повернення згідно укладеного договору. У випадку обгрунтованим підстав для повернення і відмови страхової, звернутися до суду із відповідною позовною заявою. Для цього знадобитися допомога адвоката.
