Recently, our team was asked a question: “Студент ВНЗ денної форми з січня числився добровольцем у теробороні. Військового досвіду не мав. 24.02 його прикріпили до місцевого батальйону тро. На початку березня під тиском підписав контракт про службу в батальйоні до кінця військового стану. Що це за контракт ми не можемо дізнатись, примірник йому не видали. Хоче розірвати контракт (у тексті був такий пункт) і повернутись до навчання, але командування дає зрозуміти, що його не відпустять. Чи мають право його утримувати і куди звертатись?”

15.04.2022 18:06:35 Доброго дня Щодо контракту його змісту та умов необхідно звертатись до безпосереднього командира, або до військової адміністрації. Нажаль проаналізувати зазначені терміни до закінчення військового періоду або до початку навчання не є можливим так як відсутній безпосередній текс контракту. Контракт укладають у чотирьох примірниках, які мають однакову юридичну силу та зберігаються: у командира військової частини Сил територіальної оборони ЗСУ; у ТЦК та СП; у командира; у добровольця. Угода добровольця ДФТГ може бути розірвана достроково через порушення добровольцем її умов або присяги, у зв’язку з прийняттям добровольця на військову службу, за станом його здоров’я, через вихід з громадянства України або ж — у будь-який момент — за заявою добровольця територіальної оборони про припинення контракту. Контракт відрізняється від звичайного контракту військовослужбовця ЗСУ тим, що людина може в односторонньому порядку його розірвати, що визнач в Положенні про добровольчі формуванння терито
16.04.2022 16:45:24 Доброго дня. Змусити когось укласти правочин - це грубе порушення норм Конституції України. Проте, розуміємо яка зараз ситуація. Розірвати контракт в односторонньому порядку можливо. Для цього студенту необхідно скласти рапорт на ім’я командира та подати йому. У випадку відсутності інформації на рапорт, звернутися до вищого за ланкою керівництва з цим рапортом. Утримувати його не мають права.
