Recently, our team was asked a question: “Вечер. Мой дед служил в советской армии, потом усср, на службе 60 лет, сейчас ему 85 лет и получает пенсию смешную. Я слышал что можно пересчитать военную пенсию. Каким образом можно увеличить военную пенсию? Так же знаю что военкоматы и пенсионный фонд отказывают в перерасчёте. Спасибо”

24.02.2021 22:59:25 Военные комиссариаты обязаны предоставить в орган пенсионного фонда Украины справку о размере денежного обеспечения для проведения перерасчета основного размера пенсии военнослужащего в соответствии с инструкцией о организации работы по социальному обеспечению лиц уволенных с военной службы и членов их семей. Так что следует обратится в военкомат вначале. Справка является основанием для перерасчета пенсии которую проводит пенсионный фонд. Конечно, не все так просто и есть нюансы. Следует сопоставить те составляющие денежного довольствия которые фактически были, которые определены сейчас и на какие может претендовать. Если военный комиссариат откажет в предоставлении справки, то письменный ответ можно обжаловать в суде. Если пенсионный фонд откажет перечислять - также в можно обратится в суд. Изменения в законодательстве частое явление, поэтому следует убедиться что родственник действительно имеет право на перерасчет. Смотрите постановления кабинета министров 704 от 2017 и 103 от 2018

25.02.2021 13:02:07 Перерасчет пенсий военным пенсионерам регулируется постановлениями Кабинета Министров №103 и №704. Пенсия перерасчитывается, исходя из денежного обеспечения военнослужащего, в таком процентном соотношении: с 1 января 2018 - 50% от обеспечения, с 1 января по 31 декабря 2019 - 75% от обеспечения, с 1 января 2020 - 100% от обеспечения. Чтобы начать процедуру перерасчета, вам нужно получить справку о денежном обеспечении военнослужащего (за справкой обратитесь в военкомат). Военкомат откажет в предоставлении справки, сославшись на то, что информация времен СССР и УССР передана в областной архив. После вы обратитесь в областной архив за запросом выдать справку из архивных документов. Там тоже ответят отказом. После вы обращаетесь в пенсионный фонд за перерасчетом пенсии. Пенсионный фонд тоже отказывает в перерасчете. Вы собираете отказы от военкомата, архива, пенсионного фонда, - и обращаетесь к адвокату за составлением иска в суд о перерасчете пенсий военному пенсионеру.
