За рішенням суду було встановлено те, що батько повинен сплачувати мені аліменти у зв’язку з продовженням навчання. Проте, він відмовляється платити кошти. Яка йому буде встановлена відповідальність за ухилення від сплати аліментів? Чи можуть алімети вираховуватись із допомогти по тимчасовій непрацездатності?”

22.06.2021 20:36:26 Доброго дня. Відповідальність за несплату аліментів є адміністративна, кримінальна, цивільна. Як саме покарати вирішить суд, якщо Ви будете подавати позов. Суд може накласти штраф, позбавити права виїзду за кордон, накласти аміністративний арешт, громадські роботи, все залежить від суми боргу.Якщо відповідач став безробітним, вже після рішення суду, але при цьому став на облік в центрі зайнятості, аліменти будуть відраховуватися з одержуваної допомоги по безробіттю. 24.06.2021 15:15:10 Виконавчий документпро стягнення аліментів слід пред'явити Виконавцю до примусового виконання і він шукатиме всі доходи та стягуватиме на вагу користь аліменти. Якщо коштів немає, то може бути звернути стягнення на майно.

25.06.2021 03:47:47 Доброго дня! Закони, які регулюють взаємини батьків з дитиною, зводять відповідальність за несплату аліментів до трьох сфер: цивільної, адміністративної та кримінальної. Згідно чинного законодавства, адміністративна відповідальність передбачена КУпАП, де вказано, що несплата аліментів тягне за собою виконання суспільно корисних робіт на строк від ста двадцяти до двохсот сорока годин. Щодо кримінальної відповідальності, то у ККУ вказується, що ухиленнявід сплати аліментів карається громадськими роботами на строк від вісімдесяти до ста двадцяти годин або арештом на строк до трьох місяців, або обмеженням волі на строк до двох років. Стосовно вираховування аліментів із допомоги по тимчасовій непрацездатності, якщо мається на увазі саме допомога по державному соцiальному страхуванню (тимчасова непрацездатність), то так, з неї можуть стягуватися аліменти. 28.06.2021 10:45:12 Доброго дня, за ухилення від сплати аліментів існує кримінальна відповідальність, передбачена ст. 164 кримінального кодексу України. Аліменти вираховується із доходу. Якщо ваш булько став на облік у центрі зайнятості як безробітний та йому встановлено допомогу по безробіттю, то так, за рішенням суду може бути стягнуто навіть з цих коштів.
