Проте для цього необхідно буде отримати листок із закладу охорони здоров'я, де ваша мати проходила обстеження та встановлення діагнозу. Також можуть знадобитись інші медичні документи та консультація лікаря-експерта. Рекомендую звернутися до військової командири або юриста для отримання консультації та правової підтримки у цьому питанні.

04.11.2024 20:44:34 якщо ви єдиний син і ваша мати має інвалідність ІІ групи з підтвердженням потреби в постійному догляді, то факт наявності рідного брата у матері зазвичай не впливає на ваше право на звільнення. Законодавство визначає, що у випадку, коли немає інших осіб, які могли б забезпечити цей догляд (діти або інші близькі родичі по вашій лінії), ви маєте право подати на звільнення. Для цього подайте: 1. Довідку ЛКК про необхідність догляду. 2. Заяву про звільнення з посиланням на статтю, яка передбачає звільнення на підставі необхідності догляду за членом сім’ї з інвалідністю. Таким чином, у вашій ситуації відсутність інших дітей у вашої матері є важливим фактором, і наявність брата в неї не повинна бути перешкодою.

Згідно з законодавством України, військовослужбовець може бути звільнений зі служби для догляду за батьками з інвалідністю I чи II групи, якщо вони не мають інших працездатних осіб, зобов'язаних їх утримувати. Ви, як син маєте першочергове право доглядати за своє мамою, брат може доглядати за сестрою у разі відсутності батьків, чоловіка або повнолітніх дітей.
