Recently, our team was asked a question: “З зарплати утримують 40 відсотків по суду оплату мікрозаймів,але є ще кредит в Приватбанку,який я не в змозі оплачувати.Маю пенсію 6140 і заробітну плату 2500 після виплати 40 відсотків.Виконавча наклала арешт на мої картки і вимагає ,щоб я сплачувала іще 20 відсотків на приват.Чи це законно,сплачувати 40 проц.з зарплатної та іще плюс 20 проц.Що робити?”

05.07.2024 14:53:05 Згідно законодавства, сумарна відрахування з вашої зарплати не може перевищувати 50%. Таким чином, якщо вже сплачуєте 40% на мікрозайми, то вимагання сплачувати ще 20% на кредит у Приватбанку є незаконним. Вам слід звернутися до виконавчого органу і попросити переглянути розмір відрахувань з вашої зарплати. Якщо вимога про сплату додаткових 20% на кредит у Приватбанку залишиться незаконною, вам може бути корисно проконсультуватися з адвокатом для захисту своїх прав. Необхідно також розглянути можливості переговорів з банком щодо реструктуризації кредитних платежів або пошук інших шляхів погашення боргу.

Із заробітної плати боржника може бути утримано за виконавчими документами до погашення у повному обсязі заборгованості: - у разі стягнення аліментів, - відшкодування шкоди, - заподіяної каліцтвом, іншим ушкодженням здоров’я або смертю особи, - у зв’язку із втратою годувальника, майнової та/або моральної шкоди, завданої кримінальним правопорушенням або іншим суспільно небезпечним діянням, - 50 відсотків; - за іншими видами стягнень, якщо інше не передбачено законом, - 20 відсотків. більш конкретніше надати консультацію можна тоді, коли є документи, оскільки є різні види стягнень і вони варїруються у процентному співвідношенні
