07.11.2020 00:06:24 При бронировании номера взымается (предоплата), которая обычно учитывается в оплату услуг проживания, если иное не предусмотрено договором (п. 3.2 Правил, утвержденных приказом Гостурадминистрации от 16.03.2004 г. № 19). Если потребитель забронировал номер и сделал гарантийную предоплату за проживание, то при отмене бронирования ему могут вернуть не всю уплаченную сумму. Из неё может быть удержана компенсация за бронирование. Обычно её устанавливают в зависимости от стоимости услуги проживания за сутки.

Согласно ч.5 ст.22Закону Украины «О туризме» договор на гостиничное обслуживание заключается как путем заключения письменного договора, так и путем принятия гостиницей заявки на бронирование посредством почтовой, телеграфной или другой связи, позволяющей достоверно установить лицо, от которой поступает заявка. В соответствии с пунктом 4.2 Правил пользования гостиницами и аналогичными средствами размещения и предоставления гостиничных услуг, Потребитель вправе расторгнуть договор о предоставлении гостиничных услуг в любое время при условии оплаты фактически оказанных гостиницей услуг. Порядок расторжения договора на оказание гостиничных услуг по заказчиком определяется договором и действующим законодательством. Согласно ч.1 и 3 ст.18ЗУ «О защите прав потребителей» продавец (исполнитель, производитель) не должен включать в договоры с потребителем условия, которые являются несправедливыми (условия договора о предоставлении продавцу права не возвращать средства на оплату
