Вам слід ознайомитися з законодавством своєї країни щодо прав працівників, які мають неповнолітню дитину інвалідності, та сконсультуватися з фахівцем у цьому питанні.

15.08.2024 18:23:42 Вітаю Вас! З 18 травня відбулися зміни до законодавства і звільнитися з віськової службі на підставі виховання дитини з інвалідністю майже неможливо. Згідно частини 12 статті 26 Закону України "Про військовий обов'язок та військову службу" під час дії воєнного стану військовослужбовці звільняються з військової служби через сімейні обставини на підставі виховання військовослужбовцем дитини з інвалідністю віком до 18 років, у разі відсутності інших осіб, які зобов’язані її виховувати. Якщо Ваша дружина працездатна, то Ви не зможе звільнитися з військової служби, адже вона як мати зобов'язана виховувати свою дитину. З повагою, юрист Дерій В.О.!

15.08.2024 18:36:07 Звільнення вагітних жінок і жінок, які мають дітей віком до трьох років (та у разі надання відпустки без збереження заробітної плати тривалістю, визначеною у медичному висновку, але не більш як до досягнення дитиною шестирічного віку), одиноких матерів за наявності дитини віком до чотирнадцяти років або дитини з інвалідністю з ініціативи роботодавця не допускається, крім випадків повної ліквідації підприємства, установи, організації, коли допускається звільнення з обов’язковим працевлаштуванням (стаття 184 Кодексу законів про працю України (далі – КЗпПУ)). Згідно КЗпП звільнення можливе за згодою сторін або за власним бажанням. Військовослужбовці можуть бути звільнені з військової служби з підстав виховання військовослужбовцем дитини з інвалідністю віком до 18 років, у разі відсутності інших осіб, які зобов’язані її виховувати, або ж якщо батько дитини також військовослужбовець, або жінка у шлюбі, але має статус одинокої матері. Для цього слід подати рапорт на долучити документи.
