23.09.2024 12:05:06 Вітаю, підстава для звільнення звучить так: перебування на утриманні у військовослужбовця трьох і більше дітей віком до 18 років, крім тих, які мають заборгованість із сплати аліментів, сукупний розмір якої перевищує суму платежів за три місяці. Тут ключовий фактор - це утримання, тобто підтвердження сплати аліментів. Найкраще це коли аліменти сплачуються офіційно. З колишньою дружиною, де 2 дітей і Ви платите аліменти не офіційно можна укласти договір про аліменти у нотаріуса або ж подати добровільну заяву у своїй військовій частині, щоб стягувались аліменти з Вашої заробітної плати і це буде офіційно, або ж через суд . А з теперішньою дружиною обов'язково потрібно бути у шлюбі та спільно проживати за однією адресою (місце реєстрації з дитиною та дружиною).

Згідно частини 12 статті 26 Закону України "Про військовий обов'язок та військову службу" Під час дії воєнного стану військовослужбовці звільняються з військової служби через сімейні обставини або з інших поважних причин на підставі перебування на утриманні у військовослужбовця трьох і більше дітей віком до 18 років, крім тих, які мають заборгованість із сплати аліментів, сукупний розмір якої перевищує суму платежів за три місяці.*** Ви можете звільнитись, якщо укладете з колишньою дружиною від якої двоє дітей - нотаріальний договір про сплату аліментів та матимете довідку з виконавчої служби про відстутність заборгованості по сплаті аліментів***
