Recently, our team was asked a question: “Доброго дня, підскажіть, будь-ласка, чи можу я звільнитись з ЗСУ, якщо в моєї жінки двоє дітей (від минулого шлюбу) та в мене є дитина від минулого шлюбу.
Та чи являється це підставою можливості для виїзду закордон? (Тобто якщо я проживаю з дітьми дружини чи вважається по закону що я їх утримую, якщо за них платять аліменти)”

25.01.2023 13:46:04 відповідно до ст. 23 Закону України "Про мобілізаційну підготовку та мобілізацію" Не підлягають призову на військову службу під час мобілізації військовозобов’язані жінки та чоловіки, на утриманні яких перебувають троє і більше дітей віком до 18 років. Вам треба довести факт утримання трьох дітей.
25.01.2023 14:39:09 Вітаю. Маєте право на звільнення і на виїзд за кордон. Але потрібно детальніше розібратись у ситуації, зокрема чи приймає хоча б якусь участь у вихованні 2 дітей їх біологічний батько.
25.01.2023 15:24:41 Якщо на них платять аліменти, то вважається, що їх утримаує їх батько. Однак для вас можна спробувати написати рапорт на звільнення за сімейними обставинами. Треба доводити факт утримання 3-х дітей: - аліменти щодо вашої дитини - свідоцтво про шлюб - свідоцтва про народження дітей - докази, що ви проживаєте разом з дітьми дружини. Пробуйте, це ваше право. Щодо виїзду за кордон, то документи ті самі. Можна спробувати зробити посвідчення багатодітного батька
