The Cabinet of Ministers adopted Resolution No. 361, which significantly simplified the procedures for defense attorneys during referral for treatment abroad. Under what conditions can servicemen be sent for treatment abroad
Persons from the defense and law enforcement structures, who suffered as a result of the military aggression of the Russian Federation against Ukraine, may be sent for treatment abroad to receive medical and rehabilitation assistance.
Provided which documents are available, departure is possible?
- availability of a conclusion on the necessity of referral for treatment abroad;
- availability of a message from the Emergency Response Coordination Center of the European Commission through the electronic platform "Early Warning and Response System" about the readiness of a specific country - a member of the European of the Union to receive treatment free of charge and/or written confirmation of the readiness of a foreign health care institution to receive treatment free of charge.
List of documents that must be prepared by a health care institution for the treatment of a military man abroad
Health care facilities, where defenders of Ukraine are undergoing treatment or rehabilitation, prepare the following documents for the organization of their referral for treatment abroad:
- Consent of the defender of Ukraine or his legal representative to treatment abroad with unequivocal consent to the processing of personal medical data.
- Consent to the processing and transfer of personal data to foreign health care institutions in accordance with the requirements of the law in free form.
- Conclusion on the need to refer for treatment abroad, signed by the head and attending physician of the health care institution that prescribed the treatment.
Healthcare facilities where the defenders of Ukraine are undergoing treatment or rehabilitation form these documents and send them to the relevant state body of the security and defense sector, which officially deals with protection. After receiving this information, the state body within three calendar days sends a referral letter in electronic form with copies of the necessary documents to the Ministry of Health for consideration and prepares travel permits for defenders of Ukraine.
Permissible period of stay of a serviceman for treatment abroad
The total period of stay of the defender of Ukraine for treatment abroad, including movement between foreign health care facilities and the waiting period for scheduled surgical interventions, cannot exceed 12 consecutive months.
List of documents required for border crossing by military personnel
- passport of a citizen of Ukraine for traveling abroad;
- passport of a citizen of Ukraine (in the absence of a passport - other documents containing information about the person, according to which the State Border Service provides permission to cross the state border);
- a conclusion on the need to send a person from the defense forces or security forces injured in connection with the military aggression of the Russian Federation against Ukraine for treatment abroad;
- a letter from the Ministry of Health containing a list agreed with a foreign party of persons from the defense forces and security forces who can be accepted by health care institutions of foreign countries for treatment abroad.
It is important that the departure of such persons is allowed accompanied by one of the family members of the first degree of consanguinity (parents, spouse, child, including an adopted child).
