Registration of the right of ownership of the land share in Ukraine, registration of land rights, involves entering information about the formation of a land plot and assigning it a cadastral number to the State Land Cadastre. This process is carried out in accordance with the Law of Ukraine "On the State Land Cadastre", the Procedure for maintaining the State Land Cadastre of Ukraine approved by the Resolution of the CMU of October 17, 2012 No. 1051, etc.
The cadastral number is a unique identifier of a land plot, which is used to identify it in the State Land Cadastre. The procedure for entering information and assigning a cadastral number usually includes the following stages:
Application submission: The owner or an authorized person submits an application for land plot registration and assignment of a cadastral number to the local land resources authority.
Verification of identification data: The Land Resources Authority verifies identification data and documents confirming ownership or use of land.
Land plot formation: If the land plot has not yet been formed in the cadastral system, its formation is carried out.
Assignment of a cadastral number: After conducting all necessary inspections and formation of a land plot, it is assigned a unique cadastral number.
Entering information into the State Land Cadastre: Official information about the land plot, including its boundaries, area, location and other characteristics, is entered into the State Land Cadastre. After these procedures, you will be provided with an appropriate certificate or state act on the right of ownership or use of a land plot with the indicated cadastral number.
In order to register ownership of a land plot in Ukraine, the following documents must usually be submitted:
Application: Application for registration of ownership of a land plot to the local authority responsible for registration of land rights.
Document confirming the identity of the owner: This can be a passport or other identification document.
Documents for the land plot: This can be a state act or other documents that confirm the right of ownership or use of the land plot (for example, a contract of sale, donation, etc.).
Cadastral passport: This is a document containing information about a land plot, including its boundaries, area, location and other characteristics.
Documents confirming the payment of taxes and fees: This may include property tax, title registration fee, etc.
Other documents as needed: Depending on the specific situation, other documents may be required, such as a certificate of the absence of encumbrances on the land plot or permission to change its purpose.
State registration of land plots in Ukraine is carried out by state cadastral registrars of territorial bodies of land resources. These registrars make a decision on state registration of a land plot or a decision to refuse such registration on the basis of the submitted documents and in accordance with the requirements of the law.During the registration of the land plot, the state cadastral registrars check the legality of the submitted documents, their compliance with the requirements, as well as the fulfillment of other conditions necessary for registration. They may also require additional documents or information to clarify data about the land plot.
After making a positive decision regarding the registration of the land plot, the corresponding decision is formalized with the relevant documents that confirm the right of ownership or use of this plot.
If the registrar refuses registration, he must justify his decision and indicate the reasons for refusing registration, which gives the person the opportunity to eliminate deficiencies or inaccuracies in the submission of documents, if any.
