Obtaining an employment permit for foreigners
In Ukraine, a special work permit is required for official employment of foreign citizens. This procedure is regulated by the Law of Ukraine "On Population Employment" and other normative legal acts. Let's consider in more detail how to obtain a work permit for a foreigner in Ukraine.
Who should get permission? An employment permit is required for foreigners and stateless persons who arrive in Ukraine on the basis of a visa or visa-free regime for employment. The only exceptions are certain categories exempted from obtaining such a permit, for example, foreigners who have an immigration permit.
Procedure for issuing a permit:
1. The employer - a business entity submits an application and the necessary package of documents to the State Employment Service for the issuance of a permit for the employment of a foreigner.
2. Based on the submitted documents, a decision is made within 7 working days to issue or refuse to issue a permit.
3. After a positive decision, the cost of a work permit in Ukraine is paid, which is 6.8 times the subsistence minimum for able-bodied persons.
4. An employment permit is issued for a maximum of 1 to 3 years.
Necessary documents for obtaining a permit:
- statement of the established model;
- copies of the employer's founding documents;
- justification of the expediency of using the labor of a foreigner;
- information about the foreigner's education and work experience;
- copies of foreigner's passport pages.
In some cases, additional documents may be required depending on the specifics of the work.
The cost of a work permit in 2023 for citizens of countries with which relevant employment agreements have been concluded is from UAH 7,275. For citizens of other countries - about UAH 14,550. The specified amount is paid by the employer.
In case of premature termination of employment relations with a foreigner, the employment permit becomes invalid. The employer is obliged to notify the territorial employment body about this within 3 days.
It should be remembered that employment of foreigners in Ukraine without a proper permit is considered illegal and may entail administrative, and in some cases, criminal liability for both the employer and the foreigner.
Thus, for the official registration of foreign workers in Ukraine, it is necessary to take care of obtaining an employment permit in time, having completed all the necessary documents and paying the appropriate fees. This is an important legal measure that ensures the legality of a foreigner's stay and employment in our country.
