Consideration of citizens' appeals
Citizen appeals are an important element of interaction between citizens and bodies of state power, local self-government, as well as other institutions and organizations. In Ukraine, citizen appeals are regulated by the Law of Ukraine "On Citizen Appeals", which determines the procedure for submitting and considering appeals. The appeal must be clear, specific and to the essence of the issue raised. It is advisable to attach copies of documents confirming the circumstances stated in the application to the application.
Acceptance of appeals:
Government bodies, enterprises, institutions, organizations to which citizens have appealed are obliged to accept and consider appeals. In the appeal, the surname, first name, patronymic, place of residence of the citizen, statement of the essence of the raised issue, remarks, suggestions, statements or complaints must be indicated. The application must be signed by the applicant and dated.
Consideration of appeals:
Appeals are considered on the merits of the issues presented, appropriate decisions are made and necessary measures are taken to resolve the issues raised. Appeals are considered within one month, and appeals that do not require much time are considered urgently. If additional verification is required to resolve the issue, the review period may be extended, but not for more than 45 days, which the applicant is notified of in writing.
Response to appeal:
Citizens are notified of the results of consideration of appeals in writing. The answer must state the decision taken on the appeal, as well as possible actions of the citizen, if his rights were violated.Protection of the rights of citizens in case of violation of the procedure for consideration of appeals
Citizens have the right to appeal the actions or inaction of bodies, officials in court or to higher authorities. Officials guilty of violating the legislation on citizens' appeals bear the responsibility provided for by the current legislation.
Prohibition of prosecuting citizens for filing appeals
The legislation does provide for the protection of citizens who submit appeals to authorities or other institutions. According to the law, citizens have the right to file appeals without any restrictions or harassment from authorities or other persons. No person may be penalized or subjected to other negative consequences for submitting an appeal, even if it contains criticism or well-founded remarks
Inadmissibility of coercion to submit appeals
Every citizen has the right to freely decide whether to file an appeal and what issues they want to raise. No authority or private person has the right to compel or compel citizens to submit appeals or express certain views.
Appeals that are not subject to consideration and resolution may be as follows:
Anonymous appeals:
Authorities and other institutions often require that applications be submitted with the name and contact details of the applicant. Anonymous appeals may be ignored or not accepted for consideration due to the impossibility of verification and authenticity of information.
Application without required data:
If the appeal does not contain sufficient information for a reasonable consideration of the essence of the issue or there are no necessary documents or evidence confirming the specified facts.
Issues that do not belong to the body's competence:
If the appeal concerns an issue that does not fall within the scope of responsibility or competence of the authority to which it was received, it may be forwarded to the appropriate authority or the applicant may be notified of such redirection.
Appeal from the sphere of personal relations:
Sometimes appeals that concern exclusively personal relations between citizens are not considered a subject of state or organizational competence for resolution.
Repeated appeals with the same question:
If the appeal has already been considered and resolved, and no new data or facts have been provided, then a new appeal with the same issue may be rejected as a repeat one.
Appeals with obviously false claims or excessive claims:
If the appeal contains patently false claims or excessive claims that are not supported by arguments or facts.
Appeals that are not subject to review and resolution are generally not barred from being filed, but may have no legal effect or may be dismissed for the above reasons. It is important to keep in mind the relevant requirements and rules for submitting appeals to relevant bodies or institutions.
