The arrangement of rooms in an apartment or house is far from always convenient and well thought out. Because of this, many owners resort to re-planning. But such an event must take place in accordance with the norms of the law. This is how it is possible to create not only comfortable, but also safe premises. In order to check compliance with safety requirements, a procedure for legalizing the redevelopment of an apartment is provided.

 

Replanning of an apartment: what is it

A lot of work is done to make the home comfortable. The scale of changes after the repair also differs. Depending on which structures were converted, the legal name of the performed works also changes. Currently, there are three types of housing conversion:

   ● replanning;
   ● conversion;
   ● reconstruction.
 

Replanning of a house or apartment

Each completed and commissioned building has a technical passport. An apartment in a multi-storey building as well. Re-planning is a set of works due to which the internal equipment of the premises ceases to correspond to what is specified in the document. At the same time, supporting structures and engineering networks are not affected.

 

The redevelopment includes:

   ● destroying or moving walls and partitions;
   ● destruction or creation of doorways;
   ● creating new vestibules;
   ● completion of balconies on the first floors.
 

If any of the specified works are completed, it is necessary to legalize the redevelopment of the apartment.

 

Conversion

These are changes that affect the structure of engineering structures inside the premises. For example, laying an individual heating system, or moving ventilation ducts. Conversion also includes moving gas, heating and sanitary appliances.

 

Reconstruction

Reconstruction includes all repair and construction works, during which load-bearing structures, engineering structures or the facade of the building are changed. In other words, reconstruction is re-planning and re-equipment at the same time.

 

Is redevelopment legalization required

Obtaining permission to redevelop an apartment is not only a legal requirement. First of all, this is a question of the safety of the residents of the apartment and the entire building. The law on apartment redevelopment clearly states that the changes made should not endanger the building as a whole. In addition, arbitrary redevelopment of the apartment complicates its sale. More often than not, you have to compromise significantly on the price. After all, the new owners will have to spend time and money to get all the necessary documents. The buyer risks a lot during such a deal. It is far from always possible to agree on the illegal redevelopment of an apartment.

 

Prohibited works include:

   ● demolition of supporting structures;
   ● increasing the area of the bathroom due to the reduction of the area of living spaces;
   ● combination of rooms with loggias and balconies;
   ●  moving heating devices to loggias and balconies;
   ● dismantling (even partial) of floor coverings and ventilation ducts;
   ● dismantling of floor sound insulation;
   ● creating cellars and additions to apartments located on the first floor.
 

Some people believe that arbitrary reconstruction of an apartment or its redevelopment does not interfere with living in it. That is, after conversion, people continue to use old documents without changes. Sometimes such housing is sold without legalization. But the Ukrainian legislation on the redevelopment of an apartment is quite strict with violators.

 

Illegal redevelopment, which is not agreed with the building commission, can damage the strength of the entire building and lead to emergency situations. Therefore, the legislation provides for administrative and criminal liability for violators.

 

For illegal redevelopment, you can get:

   ● fine up to 50 minimum incomes;
   ● remedial work up to two years;
   ● restriction of freedom for a period of up to three years, or up to eight years for a repeated violation.
 

In addition, neighbors can go to court and demand the removal of illegal redevelopment and the return of the building to its original state. This includes not just wear and tear single structures, as well as repairing damage to the entire building. All work is performed by the violator at his own expense.

 

How to legalize apartment redevelopment

The procedure for replanning an apartment, house or other premises is almost the same. First of all, you need to make sure that the changes made do not violate the current legislation.

 

Legalization takes place in several stages:

   1. Creation of the project. A licensed project organization puts on paper all the wishes of the owner regarding redevelopment. Development of project documentation is the first and main stage of legalization.
   2. Author supervision. It is carried out by the project organization. The purpose of the procedure is to certify the compliance of the redevelopment with the project requirements. The owner concludes a contract with the organization, and upon completion of the repair, receives a certified qualification certificate.
   4. Technical supervision. From the company. that supervises, the owner also receives a qualification certificate signed by a technical specialist. Declaration on the start of construction works. You can download it from the website of the Verkhovna Rada of Ukraine and fill it out yourself. After that, the document is registered in the Authorization Center. Within a week, it is necessary to notify the state bodies for man-made and fire safety, as well as local self-government bodies, about the start of construction work.
   5. Technical passport. After finishing the work, you need to apply to BTI to obtain a new technical passport.
   6. Declaration of facility readiness for operation. It is drawn up and registered according to the same algorithm as the Declaration on the start of construction works.
   7. Registration. It is carried out by the Department of registration of property rights to real estate.
 

To legitimize the redevelopment, you will need:

   ● passports and identification codes of all owners;
   ● title documents for real estate;
   ● receipts for payment of state duty;
   ● technical passport.
