07.03.2025 17:20:42 Ні, написання відмови від дитини не є підставою для звільнення військового зі служби. Військовослужбовець може бути звільнений з армії лише за певними законодавчо встановленими причинами, які не пов'язані з сімейним станом чи наявністю дитини. Якщо у вас є серйозні обґрунтовані причини для того, щоб ваш чоловік був звільнений з армії, краще звертатися до адвоката або консультанта по правових питаннях для отримання професійної поради.

Звільнення зі ЗСУ на підставі виховання дитини без матері передбачене лише для випадків, коли: мати померла, мати позбавлена батьківських прав, мати визнана безвісти зниклою або недієздатною. Проста відмова від дитини не є підставою для звільнення чоловіка з військової служби. Навіть якщо ви відмовитеся, держава все одно визнає вас матір'ю, поки не буде офіційного рішення суду про позбавлення батьківських прав або інших юридичних обставин.

07.03.2025 22:33:59 Відмова від дитини не є підставою для звільнення військовослужбовця з ДШВ Київ чи будь-якого іншого підрозділу ЗСУ. Підстави для звільнення зі служби під час воєнного стану Згідно з ст. 26 Закону України "Про військовий обов’язок і військову службу", звільнення можливе у таких випадках: ✅ За станом здоров'я (непридатність за висновком ВЛК). ✅ Досягнення граничного віку. ✅ Набрання законної сили вироком суду. ✅ Наявність трьох і більше дітей або дитини з інвалідністю. ✅ Самотнє виховання дитини до 18 років (якщо другий із батьків помер, позбавлений батьківських прав або зник безвісти). Чи дає відмова від дитини право на звільнення? 🚫 Ні. Якщо мати дитини добровільно відмовиться від батьківських прав, це не вплине на статус військовослужбовця, оскільки він не стає автоматично єдиним опікуном. 📌 Висновок: Звільнення можливе лише за законними підставами, тому краще шукати інші варіанти, наприклад, медичне обстеження у ВЛК або інші законні підстави для звільнення.
