Recently, our team was asked a question: “Добрий вечір. В мене така сталась історія, допоможіть будь ласка. Я прийшла в супермаркет, коли вже зробила покупки та оплатила їх на касі, пішла до виходу та пройшла спеціальні рамки «антикража» і вони почали пищати. Підійшов охоронець, переглянув чек та мої покупки, і наполягав на огляді особистих речей. Чи має він на це право? Чи понесе він відповідальність за свої дії?”

12.10.2021 23:08:15 Такі права у охоронця відсутні.Посилатись потрібно на ст. 34 Закону України «Про національну поліцію» та ст. 264 Кодексу про адміністративні правопорушення: ніхто, крім поліції, не має права проводити огляд речей. Навіть якщо на відеозаписі охоронцям примарилось щось підозріле, самостійно дивитися ваші речі вони не можуть. Потрібно викликати поліцію.На протиправні дії охоронників можна поскаржитися до інспекції у справах захисту прав споживачів, звернутись зі скаргою до прокуратури чи поліції або ж із позовом до суду.

13.10.2021 08:46:19 Відповідно до ст12 ЗУ «Про охоронну діяльність» персонал охорони під час виконання своїх обов’язків, має право:вимагати від відвідувачів припинення протиправних дій; протидіяти правопорушникам і негайно повідомляти органи Національної поліції України про вчинення крим чи адмін правопорушення; застосовувати заходи фізичного впливу, спеціальні засоби та використовувати службових собак відповідно до цього Закону; за добровільною згодою фізичних осіб під час здійснення пропускного режиму на об’єктах охорони здійснювати огляд речей, транспортних засобів, вилучати речі і документи, що є знаряддями або предметами правопорушення, перевіряти документи, що посвідчують фізичну особу; проводити відкриту відео- та фотозйомку подій як допоміжний засіб запобігання протиправним діям. Перевірка особистих речей може здійснюватися лише добровільної згоди, якщо згоди немає, охоронець повинен негайно повідомити органи Національної поліції України і затримати покупця Рекомендую здійс у присутності 2 свідків
