Якщо у вас є претензії до цієї квартири, вам слід звертатися до нового власника або до суду для захисту своїх прав. Важливо мати документи, які підтверджують вашу правомірність на цю квартиру.

26.10.2024 08:05:47 Вітаю! Якщо квартира була переоформлена шляхом укладення договору купівлі-продажу в нотаріуса, то вона вважається правом власності покупця як добросовісного набувача. Проте, не вилючено, що свої права доведеться відстоювати у судовому порядку.

26.10.2024 14:19:16 Квартира є об'єктом нерухомості, а тому застава квартири обов'язково підлягає нотаріальному посвідченню. Якщо квартира у заставі, при купівлі кожен продавець повинен повідомити покупця про наявність прав третіх осіб на цю квартиру, це стосується і права застави. Якщо продавець не повідомив покупця про існування застави на квартиру, покупець має право вимагати розірвання договору купівлі-продажу та повернення сплачених коштів. Крім цього, продавець може продати квартиру лише за згодою заставодержателя. Чи була така згода, у питанні не зазначається, але це є важливим питанням. Дуже важливо ознайомитися зі змістом договору купівлі-продажу та із договором застави, різні нюанси можуть вплинути на зміст консультації. Якщо заставодержатель в судовому порядку почне вимагати від такого покупця передати квартиру чи інші вимоги, продавець обов'язково повинен повідомити про таке покупця та подати до суду клопотання про залучення покупця до справи. Інакше продавець не відповідає перед покупцем.
