13.06.2021 20:36:29 Так, адже власника змінює спадкоємець і договір продовжує свою дію. Краще із спадкоємцем укласти додаткову угоду про заміну сторони. Якщо ж впевнені, що спадкоємець не погодиться, то краще залишити все як є і продовжувати користуватись до закінчення договору

Згідно ст. 412 ЦК України право користування земельною ділянкою для сільськогосподарських потреб припиняється у разі: поєднання в одній особі власника земельної ділянки та землекористувача; спливу строку, на який було надано право користування; викупу земельної ділянки у зв'язку із суспільною необхідністю. Право користування земельною ділянкою для сільськогосподарських потреб може бути припинене за рішенням суду в інших випадках, встановлених законом. Таким чином, Ви можете користуватися земельною ділянкою до спливу строку договору, після чого вже домовлятися із спадкоємцем, якому перейде ця земельна ділянка у власність, про підписання нового договору. Якщо там не визначено перехід прав та обов’язків до інших осіб, то за загальним правилом, установленим ст. 770 Цивільного кодексу України, у разі зміни власника речі, переданої у найм, до нового власника переходять права та обов’язки наймодавця. Подібне положення міститься і в ч. 1 ст. 1481 Земельного кодексу (далі – ЗК): до особи, яка набула право власності на земельну ділянку, що перебуває у користуванні іншої особи, переходять права та обов’язки попереднього власника земельної ділянки, передбачені чинними договорами оренди, суперфіцію, емфітевзису, земельного сервітуту.
