Recently, our team was asked a question: “Вітаю. Купив житло у новобудові на стадії будівництва та відразу оформив право власності. Пройшло 2 роки, але світло та газ не підключили і невідомо коли підключать, а відповідно до договору все має бути готове і я в цей час можу поселятись . Чи можу я, відповідно до законодавства,вимагати у них компенсацію за прострочення договору? Дякую.”

Можете також свернутись до суду, який найвірогідніше прийме рішення на Вашу користь, в позові також просіть суд про стягнення судового збору з відповідача. Ще продивіться уважно договір, там повинно бути вказані штрафні санкції за порушення умов договору. Дякую.
11.07.2021 22:05:42 Доброго Дня КГС ВС визнав, що, навіть якщо забудовник у договорі не прописав можливість компенсації за зрив термінів здачі житла, покупець все одно може претендувати на таку компенсацію. Колегія суддів КГС ВС врахувала правову позицію Великої палати ВС, висловлену в постанові від 1 вересня 2020 року у справі №216/3521/16-ц, і зазначила, що незважаючи на відсутність у договорі застереження щодо покриття моральної шкоди, таке відшкодування може бути стягнуто на підставі Закону України «Про захист прав споживачів». У своєму висновку КГС ВС посилається на Цивільний кодекс, де в першій і другій частині ст. 23, ЦК що кожен громадянин може розраховувати на відшкодування моральної шкоди, яку заподіяно внаслідок порушення його прав. Компенсацію можна вимагати: штраф за порушення термінів здачі об’єкта може бути встановлено договором; витрати на оренду нерухомості; втрачений дохід. Успіхів
