Recently, our team was asked a question: “Купила в Цитрусе телефон (айфон). Пользовалась приблизительно 1 месяц, ничего не беспокоило. После телефон начал быстро садиться. Проверила состояние батареи - 58%. Обратилась в магазин, мне отказались менять - так как прошло 14 дней и не известно, что я с ним делала. Убеждали что я купила новый телефон и это не их вина. Как сделать замену либо возврат телефона? Как притянуть к ответственности продавца за бракованный товар? Как защитить права покупателей?”

28.09.2020 13:46:12 По истечении 14к/дней с момента покупки возврат/замена возможны только по гарантии при установлении, в т.ч. и экспертизой, сущ-ых недостатков товара, которые возникли по вине производителя товара (продавца), или фальсификации товара (ст.8 ЗУ О защите прав потребителя), делают невозможным/недопустимым целевое использование товара, после ремонта такой недостаток проявляется снова по независимым от покупателя причин, вообще не может быть устранен, либо на его устранение требуется более 14 дн., либо ремонт делает товар совершенно другим, нежели предусмотрено договором. Продавец может проверить качество товара в течение 14 дн. или по договоренности сторон. При предъявлении требований покупатель должен предъявить продавцу чек, квитанцию и т.п., гарантийный талон, паспорт и т.п. Пишите заявление в 2-х экземплярах, прикладывайте документы на телефон. Продавец не имеет права отказать в рассмотрении заявления. Защита прав покуп-лей - в суд. порядке, либо через жалобу в террит. упр. защит потр.

Втім, якщо протягом гарантійного терміну виявлено недоліки це також підстава для пред’явлення претензії . Наша юридична фірма займається схожими справами. Радимо підготувати письмову претензію та після отримання відмови звернутися до суду. Для належно захисту необхідно ознайомився із гарантійною документацією
