02.12.2023 14:06:35 Призупинення дії трудового договору представників педагогічного колективу з ініціативи керівництва навчального закладу комунальної форми власності Київської області на період зимових канікул можливе, але це повинно мати належну підставу. Згідно з Трудовим кодексом України, роботодавець має право призупинити договір про працю у разі введення непередбачених законом або колективним договором обставин (наприклад, епідемія, аварія) або у разі необхідності проведення ремонтних робіт. Таким чином, якщо існують достатньо обґрунтована причина для призупинення договору про працю представникам педагогічного колективу на період зимових канікул (наприклад, проведення ремонтних робот або введення непередбачених обставин), то таке призупинення може бути належною підставою. Однак, роботодавець повинен дотримуватися вимог законодавства та колективного договору, якщо такий існує, щодо процедури призупинення договору про працю та компенсацій для працівників. Рекомендується звернутися до відповідних нормативно-правових актів та консультуватися з юристами або профспілковими органами для отримання точної інформації та порад щодо даного питання.

04.12.2023 15:01:16 Належною підставою призупинення трудового договору є відсутність можливості обох сторін трудових відносин виконувати обов’язки, передбачені трудовим договором, у зв’язку із збройною агресією проти України. Настання канікул не є належною підставою.
