Recently, our team was asked a question: “Якщо я не сплачуватиму оплату на садове товариство (охорона, ремонт доріг, освітлення, благоустрій). То які можуть вжити щодо мене санкції? Не допускати мене та моі ТЗ до моєі ділянки? Маю кадастровий номер та ділянка на мені згідно Кадастровоі карти публічноі, електрика не підключена, лише фактично постійно застосовую ділянку для ОСГ.”

09.11.2023 19:24:12 Я не є юристом, але можу надати загальну інформацію. У разі невиплати оплати на садове товариство, органи управління товариством мають право вжити різних санкцій проти вас. Зазвичай, це можуть бути такі заходи: 1. Нагадування та попередження: Спочатку вам можуть надсилатися листи з проханням сплатити заборгованість та попередження про можливі наслідки. 2. Обмеження доступу: Товариство має право обмежити ваш доступ до доріг, освітлення та інших загальних благ користувачам, якщо ви не сплачуєте свої обов'язкові внески. 3. Правовий захист: Товариство може подати позов до суду для стягнення боргу з вас. Якщо суд прийме рішення на користь товариства, то йому буде надано право стягнення боргу шляхом конфіскації майна або інших юридичних заходів. 4. Інші санкції: У кожному конкретному випадку можуть бути залучені інші санкції, передбачені статутом товариства або законодавством країни. Зверніться до свого місцевого юриста або органу управління товариством для отримання конкретної інформації про правовий статус та процедури в вашому конкретному випадку.

10.11.2023 18:55:17 Вітаю! Це борг, можуть стягувати через суд заборгованість по сплаті таких послуг, а в рамках судової справи про стягнення боргу можуть накласти арешт на земельну ділянку. Якщо ділянка у вашій власності не допускати до неї Вас не можуть. А якщо ділянка лише у користуванні, варто передивитись договір з садовим товариством можливо якщо лише у користуванні тоді можуть забрати ділянку з користування. Перевірте в першу чергу користування у вас чи власність.
