11.11.2022 11:20:09 Стаття 318 Кримінального процесуального кодексу України встановлює: судовий розгляд має бути проведений і завершений протягом розумного строку. Скільки часу може тривати розумний строк — кодекс не зазначає. Тривалість розумного строку визначається суддею, який розглядає справу, з врахуванням складності справи. Можна подати заяву судді про те, що учасники справи зловживають процесуальними правами, заявляючи про постійні відкладення розгляду справи. Це якщо в тих учасників дійсно немає законних підстав відкладати розгляд справи і вони просто тягнуть час. Законних засобів вплинути на самого суддю щоб прискорити розгляд справі не існує.

Як варіант, можливо написати письмову заяву на ім'я головуючого судді про призначення та розгляд справи у розумні строки. Також схоже звернення може написати і прокурор, який підтримує державне обвинувачення.

11.11.2022 14:02:58 Нажаль ні. Можна писати клопотання, подавати скарги, проте бажаного ефекту, В не отримаєте, а зважаючи на воєнний стан, судовий процес буде й надалі тривати. Проте це не позбавляє Вас права подачі цивільного позову у рамках кримінального провадження. Відшкодування майнової шкоди в рамках кримінального провадження має певні особливості: відповідно до ст. 127 КПК України, підозрюваний, обвинувачений, а також за його згодою будь- яка інша фізична чи юридична особа має право на будь- якій стадії кримінального провадження відшкодувати шкоду, завдану потерпілому, територіальній громаді, державі внаслідок кримінального правопорушення. Шкода, завдана кримінальним правопорушенням або іншим суспільно небезпечним діянням, може бути стягнута за судовим рішенням за результатами розгляду цивільного позову в кримінальному провадженні. Шкода, завдана потерпілому внаслідок кримінального правопорушення, компенсується йому за рахунок Держ бюджету України у випадках та в порядку, передбачених законом
