28.04.2022 15:14:44 Відповідь на ваше питання : чи маєте ви докази, щоб підтвердити, що роботодавець вказав вас сидіти дома та не виходити, докази це покази свідків, документальне підтвердження, докази у вигляді наказів переписок, тощо. Якщо доказів немає до вказати що Ваш роботодавець здійснює неправомірні дії та притягнути його до відповідальності буде не можливо. Якщо докази є то можна вказувати на неправомірність дій. Також зазначу, що норми Закону України «Про організацію трудових відносин в умовах воєнного стану» від 15.03.2022 р. № 2136-IX (далі - Закон № 2136), який діятиме винятково протягом воєнного стану, значно розширюють права роботодавця, і звужують робітника.Протягом періоду дії воєнного стану роботодавець на прохання працівника може надавати йому відпустку без збереження заробітної плати без обмеження строку, встановленого ч. першою ст. 26 Закону про відпустки. А також не можна не дотримуватися норми про звільнення без попередження 2 неділь. Тому спробуйте домовитись з роботодавцем.

28.04.2022 15:42:44 Доброго дня. Ви ж розумієте, що слова роботодавця "сиди вдома", як кажуть, до справи не підшиєш. Іншими словами Вам важко буде, в разі звільнення, довести, що прогул стався не з вашої вини, а за вказівкою роботодавця. Тому, доцільніше напевне написати у ті дні, у які Ви не працювали, заяву про надання відпустки без збереження заробітної плати, або як її ще називають за власний рахунок.
