Recently, our team was asked a question: “Добрий вечір. Я взяв кредит на покупку квартири. Рік тому мене звільнили з роботи, тому я не мав змоги оплачувати кредит. Цю справу передали в клекторську компанію. Колектор погрожує мені, телефонує моїм рідним та друзям. Чи буде він нести відповідальність за свої вчинки? Чи його дії є правомірними? Дякую”

05.10.2021 08:42:46 Звичайно погрози не є правомірними діями, в ступні вини колекторів повинні розбиратись правоохоронні органи. По-перше, потрібно дізнатися назву колекторської компанії, працівники якої до вас телефонують. Якщо колекторська компанія належить до фінансових установ необхідно зателефонувати до контакт-центру НБУ за телефоном 0-800-505-240 або заповнити форму онлайн звернення на сайті НБУ за посиланням: https://bank.gov.ua/ua/consumer-protection/citizens-appeals чи надіслати електронного листа на пошту НБУ: nbu@bank.gov.ua. Якщо колектори погрожують, потрібно обов’язково звернутися до правоохоронних органів. Бажаю успіху.

07.10.2021 16:12:04 Доброго Дня До ваших родичів та близьких почали телефонувати тому, що ви перестали сплачувати кредит, не звертались до банку для врегулювання (відстрочки, канікул, пільг, дод. угод) та перестали відповідати на дзвінки. Дії колекторів не законні і спрямовані на психологічний тиск, але притягувати їх до відповідальності бесперспективно, проте у разі ґрунтовних погроз звертайтесь до поліції Сконцентруйтесь на Ваших діях виробіть стратегію вашої поведінки з банком, почистіть свої соціальні мережі, проконсультуйтесь з представниками банку, зберігайте для доказів переписку, листи з банку та від колекторів, обговоріть доцільність стягнення коштів у виконавчому провадженні, мониторите наявність судових проваджень по своєму ПІП https://court.gov.ua/fair/, контролюйте наявність виконавчих написів нотаріуса для його оскарження.
