23.04.2023 18:04:46 Норми Кодексу України з процедур банкрутства правом на звернення до господарського суду із заявою про відкриття провадження у справі про банкрутство наділяють як кредитора, так і боржника. Відповідно до частини 2 ст. 34 КУзПБ, до заяви кредитора додаються: докази сплати судового збору, крім випадків, коли згідно із законом судовий збір не підлягає сплаті; довіреність чи інший документ, що засвідчує повноваження представника, якщо заяву підписано представником; докази авансування винагороди арбітражному керуючому трьох розмірів мінімальної заробітної плати за три місяці виконання повноважень; докази надсилання боржнику копії заяви і доданих до неї документів. Боржник має право звернутися до господарського суду із заявою про відкриття провадження у справі про неплатоспроможність у разі, якщо: заборгованість становить не менше ніж 30 мінімальних розмірів заробітної плати; боржник припинив погашати кредити або здійснювати інші планові платежі в розмірі понад 50 % місячних платежів; винес
