07.04.2023 13:18:35 В Вашому випадку лише роботодавець може за рахунок власних коштів здійснювати Вам виплату пов'язану з відшкодування шкоди, заподіяної працівникові внаслідок ушкодження його здоров'я. Однак нормами Кодексу законів про працю України встановлено, що працівник не може бути допущений до роботи без укладення трудового договору, оформленого наказом чи розпорядженням власника або уповноваженого ним органу та подання повідомлення до територіальних органів Державної податкової служби. Відповідно до ст. 232 Кодексу безпосередньо в районних, районних у місті, міських чи міськрайонних судах розглядаються спори працівників про оформлення трудових відносин у разі виконання ними роботи без укладення трудового договору та встановлення періоду такої роботи. Отже Ви маєте право звернутися до суду за захистом своїх прав.
